Terms & Conditions

General

1. These terms as well as Crowdfunder’s terms of use govern your participation in the BA Better World Community Fund via Crowdfunder (Fund) under which your project receives Funding from British Airways Plc (Funding). References to “We” refer to the British Airways Plc and Crowdfunder Limited.

2. If You are participating in the Fund on behalf of an organisation, You agree that your organisation will also be bound by these Fund Terms and Conditions and Crowdfunder’s Terms of Use. If You do not want to be bound (or your organisation does not want to be bound, if applicable) by the Fund Terms and Conditions and Crowdfunder’s Terms of Use, please do not participate in the Fund.

3. In the event of inconsistency between these Fund Terms and Conditions and Crowdfunder’s Terms of Use, these Fund Terms and Conditions shall prevail.

4. If there is any reason to believe that there has been a breach of these Fund Terms and Conditions and/or Crowdfunder’s Terms of Use, We may, at our sole discretion, exclude any project owner, organisation, backer or user from participating in the Fund.

5. We do not accept any responsibility for:
a. verifying the identity of any project owner, organisation, backer or user;
b. the content of project pages or applications for Funding;
c. the offering or fulfilment of any rewards on project pages;
d. the success of a project in the Fund, including whether a project receives Funding as a result of participating in the Fund and the value of such Funding;
e. for pledges to projects, save that British Airways will be responsible for the pledges it makes; or
f. for the management or use of pledges raised in connection with the Fund by project owners or organisations.

6. These Fund Terms and Conditions are subject to the laws of England and Wales.

7. We reserve the right to hold void, suspend, cancel or change the Fund, and may amend these Terms and Conditions from time to time.

A. Avios

Projects which participate in the Fund may be entitled to receive donations in the form of Avios. Please see Section D of Crowdfunder’s terms of use for further terms relating to Avios for project owners and backers.

Avios match fund

Match funding applies to Avios donations made to Comic Relief fundraising pages only. Avios donation matching is in addition to the funding already pledged by British Airways through the Community Fund. Pledges will be matched pound for pound between 10:00 GMT on 7 February 2024 and 14:00 GMT on 18 March 2024 or until the total match funding amount of £100,000 is reached (whichever is sooner). Donations can be made in increments of 125 Avios, minimum donation 125 Avios, maximum donation 30,000 Avios per British Airways Executive Club (BAEC) Member per calendar month. Donation must be made by a BAEC Member, aged 18+ with a Crowdfunder account. Full donation terms and conditions can be found at bacommunityfund.co.uk/terms-conditions.

B. Terms and conditions for Project Owners

Eligibility Criteria

You confirm that your organisation meets the eligibility criteria for the Fund and You confirm that all information provided in your application for Funding is true and accurate.

Fees

Crowdfunder will charge the following fees on pledges to Your project. This will be deducted from the pledges before they are transferred to You:

Claiming your Funding

You must set up a wallet with Crowdfunder’s third party payment services provider, Mangopay via the Crowdfunder platform.

You must draw down Your Funding through Crowdfunder within 3 months of the successful completion of your crowdfunding campaign, any Funding not drawn down after three (3) months will be deemed unspent and returned to the Fund.

Using your Funding

Your Funding should be used for the specific purposes as set out on your Crowdfunder campaign page, if You are unable to use the Funding for the purposes set out on Your Crowdfunder campaign, please notify us as to how You intend to spend the Funding at [email protected]. We will advise whether the revised use of the funds or extended timeline is approved, or whether the Funding distributed to You must be repaid or Your application has been rejected, as appropriate.

You must maintain proper accounts for the Funding received and we may ask You to provide evidence of how You have spent the Fundings. If You fail to provide this information, action will be taken to recover the Funding You received.

Evaluation

You will also be asked to complete a short questionnaire about your project and crowdfunding experience, one before Your campaign completes and one 6-8 weeks afterwards. You may also be asked to take part in a short interview about your experience of the Fund. You agree for Your contact details to be passed on to us for this purpose and to supply any information requested in a timely manner. We agree to use any contact details in compliance with any relevant data privacy and GDPR laws.

Branding & recognition

We may wish to use your campaign details and the Funding to form part of a case study that We will publish on Our website or social media platforms to show good-practice and provide support to other organisations wishing to crowdfund as an alternative source of funding. We will discuss and agree the contents with you.

The ‘BA Better World’ sub-brand introduces a bespoke colour palette and suite of logos. To maintain British Airways’ brand awareness, please always use the British Airways Masterbrand identity in the first instance. However, if a communication is solely led by ‘BA Better World’, then the below guidelines can be followed. Any use of this sub-brand MUST be approved by the British Airways Brand team, including all proposed designs carrying the colour scheme and logo.

Organisational issues

Please inform Us in writing of any major changes to your organisation, this may include impending mergers, financial difficulties, significant loss of funding, significant changes in staffing, and/or Charity Commission / Companies House matters. If you change your address or contact details, please inform us via email ([email protected]) providing details of your new address and contact details.

Relationship between the parties

You acknowledge that if Your Project is approved for Funding this does not create any relationship between You, the organisation and Us other than is specified in these Fund Terms and Conditions and the Crowdfunder Terms of Use. There is no official partnership or similar arrangement created between the parties as a result of your participation in the Fund.

Additional terms

Where applicable, You must have insurance and all relevant consents and approvals for any activity which the Funding will be wholly or partly funding.

We reserve the right to withdraw, reduce, vary or withhold the Funding, in whole or in part in the event of any failure to comply with these terms and conditions, Crowdfunder’s terms and conditions or where the law is not being complied with.

Crowdfunder may continue to review your Project even after it is accepted to participate in the Fund and British Airways reserves the right to remove a Project from the Fund at any time if it is identified that the Eligibility Criteria are not met. You will also be ineligible to receive Funding if, at our sole discretion We are not satisfied that all the Supporter pledges on your project are genuine pledges.

Where Projects or pledges are identified as fraudulent, potentially fraudulent, or demonstrative of manipulating the pledging on a project in order to obtain Funding, this is taken very seriously. Where appropriate, the police or other relevant authorities will be informed. In addition:

•  Your application for the Fund will be refused and any existing commitment for Funding will be withdrawn.

•  Your Crowdfunding project may be cancelled and you will be ineligible for future applications or projects.

•  Action will be taken to recover Funding which has been paid out.
